this morning when firefighters responding to a medical call at a home on dwight way near san pablo avenue. christie smith is live on the scene. she has the latest for an update on this situation. good morning. >> reporter: good morning to you. i just spoke with berkeley police. they say this was very unusual. firefighter got a medical cal to a home on dwight way. when they arrived, they were only here for a couple of minutes when someone inside of the home started shooting. a man believed to be in his 80s. one firefighter was hit, grazed but treated at the scene and is recovering. this started around 1:41 this morning, a small home on the 1200 block of dwight way. five firefighters responded to help with this medical call. about ten minutes in, they called berkeley police asking for help and then they called back and said this had escalated. a man had opened fire. all of the firefighters made it out and the man barricaded himself inside. >> it was a very small residence.

so i could imagine that the situation was very scary for them but they were able to get out and, you know, luckily this didn't last too long. he was -- did surrender. there was no further incident after that. >> the police recovered evidence from the home. after making contact with this elderly man, there were other people in but they made it out okay. other people inside the home. now, why it turned violent, at this point, they don't know. i can tell you that the man was arrested, taken to a hospital. he is being held for medical evaluation. then, police will determine what charges will be filed. reporting live in berkeley, christie smith, "today in the bay." 4:34. new this morning, san jose police officers recovering after a hit-and-run driver crashed into him outside hp pavilion. it happened after 11:30 in the parking lot after a sold-out concert. after hitting the officer, the

driver drove the wrong way down delmas avenue and turned eastbound along san fernando street. he was caught in the act by the owner of the car he was attempting to burglarize. the suspect jumped into his own car and fled the parking lot. >> the vehicle is a four-door black acura integra. it might have damage to the front left side. we have every officer in the city looking for that car. >> the officer was taken to the hospital with nonlife threatening injuries. >> the parents of audrie pott are expected to speak for the first time. she is the girl that killed herself after an alleged sexual assault that involves cyberbullying. we don't usually identify the victims but in this case, her parents want her story told to try and prevent other tragedies. her attorney is planning to file a wrongful death suit against three 16-year-old boys who now face felony charges in this

case. this past friday, an attorney for the boys releasing a statement calling media reports linking the boys' actions to her death disturbing. the attorney for the pott's family is responding. >> this tells us they are still in denial, not accepting responsibility or remorseful at all. >> the pott family attorney says she killed herself after photos were sent by text message and e-mails to several students at her high school, saratoga high school. they are expected to talk about audrie's law, a law being pushed for that would increase penalties for cyber bullying and sexual assault ylaws. san jose state students are on alert after an early morning robbery. they received an e-mail saying a man used a pistol to rob a student outside the freshman

dorm around 4:00. the area is patrolled, rather, by police regularly. it is not usually deserted. even in the early morning hours. police are warning students not to walk or bike alone after dark. in palo alto, police looking for the man who robbed a local credit union. police say the proof dent credit union on el camino real near page mill was robbed at about 9:00. this man was caught on surveillance video. he handed the teller a note saying he had a gun but he never showed the gun. the man drove off in a silver or gray thunderbird. that same credit union was robbed back in january. police did make an arrest in that case. >> the trial for an accused serial killer is set to begin in less than two weeks. today, lawyers will make their final pre-trial motions in that case. joseph massa is set to go on trial for the murders of four women. he is acting as his own attorney. his trial has been through a

series of delays as he has fired and hired several advisory lawyers. the alleged murders took place from the 1970s to the 1990s more than a dozen people recovering after a tour bus crashed. it was traveling on highway 41 when the driver lost control, crashed right into a tree just outside the park. all 16 of those passengers were injured. however, the driver was not hurt. the bus is owned by a tour company in burlingame that caters to chinese-americans. chp says the driver was likely traveling too fast and that is what caused him to lose control. the driver reportedly told the chp the bus had a steering problem. teachers in a bay area school district are planning a protest to demand smaller classes and bigger paychecks. teachers in the fremont school district say their class sizes have gotten out of control as a

result of budget kcuts. negotiations have stalled. teachers will be handing out fliers to parents at all fremont unified school campuses this morning. time now is 4:38. christina loren is back telling us you may want to prepare for raindrops. >> we are not going to see too much in terms of rainfall. we will see strong winds. what's happening is jetstreams are located on top of us. you can count on some active weather elements. 45 degrees to start in napa. you are at 43 in santa rosa. it looks like the north bay will be getting hit the hardest with the strong winds that develop. we will show you what we are talking about in terms of shower activity. if you live anywhere north of 92, it looks like you are going to stay nice and dry for the time being. we are going to continue to update you every 10-15 minutes. winds are starting to pick up in the north bay. look at novada west.

good morning. i'm thinking of food now. let's talk about the stock futures for a second. they are lower this hour. the market is coming off another positive week. the dow posting its third best week of the year. china in the news as a report shows growth of the world's second largest economy is slowing down a bit. here at home, we get that. the flood of earnings continues this week with a third of the dow jones. nothing in the dow but the biggest name is citigroup. they slipped to 14,865. the nasdaq losing 5 to 3294. general motors and ford dropping their long-standing differences and teaming up to work on more fuel-efficient transmissions. the system would go into most of their new vehicles. they could save millions of dollars which could help keep prices competitive. analysts say. this could add at least two miles per gallon.

coming off a really nice weekend. >> worst day of the week weatherwise today, monday but let's get it all out of the way right off the bat and then you can enjoy the rest of the week. we do have some strong winds. want to make sure you are aware of that as you make are way out the front door. it is also chilly and temperatures will drop off as we head through the next few hours. you might have to use your heater which we have been able to give it a break over the past couple days. we are only going to reach the low 60s and upper 50s. you will need your jacket. that is something we haven't had to deal with for quite some time. we have a major warmup headed our way. right now, watch out for a little bit of shower activity, specially in the south bay. that will be the case until 9:00 a.m. then, these winds are really going to pick up. that will be the weather story of the day. watch out. westbound wind sustained at 17 miles per hour in livermore. the wind advisory doesn't go into effect until 11:00 a.m. that stands until 9:00 p.m. as

the jetstream sits right on top of us. keep that in mind. it is going to be a blustery day. not a great day for the hat. not a wonderful day for the sundress as those winds will be rather strong, specially towards the end of the day. gusty north wind. otherwise, we are looking pretty good. seven-day outlook. we are headed toward the mid to upper 80s by this upcoming weekend. go ahead and start thinking about it. 4:48. the deadly costa concordia, a cruise ship disaster is back in court. the court is weighing possible indictments against six crew members including the ship's captain. he is accused of running the cruise ship aground off the coast of italy last january. 32 people died in the wreck. the captain is facing manslaughter charges for causing the disaster. it is a huge week on capitol hill with both immigration and gun control taking center stage. compromises on both issues could

come up for a vote this week. a bipartisan group of lawmakers known as the gang of eight is expected to unveil its immigration bill sometime tomorrow. it would help secure the border and allow tens of thousands of foreign workers into the country and create a path to eventual citizenship for the estimated 11 million people living in the u.s. illegally. in the meantime, on gun control, a new deal would expand backgrou background checks to gun shows and internet sales. making it harder for criminals and the mentally ill to get weapons. the plan facing bipartisan opposition. >> we are spending all of our time talking about background checks as if criminals will no longer get guns because they have to undergo a background check. >> the bill will come up for a vote by mid-week. starting today, people in new york who own assault weapons must register them. the deadline to do so is by

august, 2014. now, there is a limit of seven rounds per magazine, except at competitions or firing ranges. nra officials say the new laws violate the constitutional rights of law abiding gun owners nevada department of health and human services defending their mental health program after they report the state's primary hospital bussed more than 1500 patients right out of the state over the last five years. one patient ended up in sacramento where he had no family and never had been before. the health and human services department said the majority of patients shipped out of state are shipped to family members and deemed healthy enough to travel. the sacramento case was a rare mistake, he says faa regulators will order special inspections on 1,000 737 jets. some may have improperly

"today in the bay's" christie smith joins us live in berkeley with an update on the situation. good morning. i'm gathering more information from berkeley police. they are telling me this elderly man who opened fire is 88 years old. one firefighter was hit in all this. then, the man actually barricaded himself inside this home in berkeley on twdwight wa. that firefighter was grazed and is recovering. possibly back at the fire station that started at 1:45 this morning. when firefighters arrived to this home on a medical call. about ten minutes later, they

called berkeley police saying this had escalated, that the 88-year-old man had fired a gun. aum t all the firefighters made it out, including the injured firefighter. he barricaded himself inside the home but eventually surrendered to berkeley police. >> it is a little unusual for us to have this type of incident. i'm sure the fire department, that's not what they expected when they had to respond to this type of call for service. thankfully, there was only a minor injury to one firefighter. there was no further injuries to police personnel or the gentleman or any of his families. >> berkeley police spent some time at the home gathering evidence. there was another person inside the home who made it out safely. the man was taken to a hospital for evaluation. they are going to check his mental status. they are still not sure if that was the cause of this or if there was some sort of criminal intent. they say when they sort that
